ayotte proposes amendment 3245. ms. ayotte: thank you very much. i rise in support of my amendment 3245. last year in the defense authorization bill we had in it a prohibition that would prohibit transferring those thosh held in -- who are knelled custody at the guantanamo bay facility from there to the united states of america. this year as the language of the defense authorization stands, there is no such prohibition in that, making it possible for the administration, should it choose, to transfer from the guantanamo bay detention facility 166 foreign enemy combatants that are currently being detained at guantanamo. i am deeply, deeply concerned that the defense authorization does not include this prohibition of transfer language, and that is why i have brought forth this amendment. i'm also pleased this amendment is being cosponsored by the vice chairman of the senate select committee on intelligence, senator chambliss, as well as senators inhofe, graham, kirk and senator sessions. we have at guantanamo bay a top-rate facility that allows for th

i walked back from that stakeout to here with kelly ayotte, one of the three. she said a few things. she said, first of all, she does not feel that in her position as u.n. ambassador, u.s. ambassador to the u.n., going out on five sunday shows she asked the proper questions she needed to ask to make sure she was not misleading the american people about what happened in benghazi. she said that that how she feels coming out of the hour-long meeting she had, behind closed doors with susan rice. the second thing she's concerned about, she meaning senator ayotte, is that when susan rice was on these shows, she was very careful to read from the talking points that were unclassified, talking about extremist elements. she also went a step further in some interviews saying that the obama administration has decimated al qaeda. what senator ayotte and other senators have said is that was misleading because she knew in a classified way that al qaeda might have been behind it. so that is what one -- two of the reasons why at least senator ayotte said that she is troubled. a

senators ayotte, graham and mccain, republicans who had from the get-go before they talked to her vowed -- or threatened to block her nomination. so that was one thing. today is different because that senator you just played, susan collins, is among the last remaining moderate republicans here. she does have a lot of information about what happened because she is the top republican on the homeland security committee, and she actually has a history of supporting susan rice. she was the one who introduced susan rice when she was at her confirmation hearing for the post she's in now as u.n. ambassador. so the fact that susan collins even has questions, i asked her point blank if she could support rice for secretary of state, and her answer was not yet. she has to have other questions answered. that's not a good sign for rice, but we should underscore a couple of things. one, she hasn't been nominated yet. and, two, she -- rice does have a lot of support from democrats who still have the majority. the issue is whether or not she'll need, if she's nominated, 60 votes to get confirmed. >> wha
